Bart J. Eagle — Attorney & Mediator
Bart J. Eagle formed the Law Offices of Bart J. Eagle, PLLC in 1997, to help clients resolve disputes and structure commercial transactions. His clients are a diverse mix of small and mid-size business, entrepreneurs, business owners and individuals. With a full understanding of his client’s goals in a matter, Mr. Eagle develops a strategy to achieve them and represents their interests tenaciously in matters of litigation and in structuring and negotiating business transactions.
Mr. Eagle has represented clients in federal and state courts, before administrative tribunals, and in arbitration and mediation proceedings. He has handled a wide variety of business litigation matters including disputes resulting from commercial financing relationships; shareholder and partnership disputes; disputes arising from license and distribution agreements; employment disputes; contract actions; RICO claims; securities frauds actions; and insurance coverage disputes. In addition, Mr. Eagle has negotiated and drafted commercial agreements including factoring, license, employment, severance, distribution, asset purchase, collaboration, service, shareholder, operating, and partnership agreements, as well as leases and assignments of intellectual property rights. Mr. Eagle is a member of the New York State Bar Association Commercial and Federal Litigation Section, and is a member of the New York City Bar Association State Courts of Superior Jurisdiction Committee and the President’s Committee for the Efficient Resolution of Disputes.
Mr. Eagle also serves as a mediator, helping parties in dispute resolve their conflict. Drawing on his experience as a litigator and business attorney, as well as his extensive training in mediation and experience as a mediator, he helps parties identify their interests and needs, and the strengths and weaknesses of their and their adversary’s positions, so that they can engage in a constructive effort to resolve their dispute. Mr. Eagle is on the panel of mediators of the United States District Court, Southern District of New York, the rosters of mediators of the American Arbitration Association, the Commercial Division of the Supreme Court of the State of New York, County of New York, and the Coop and Condo Panel of the New York City Bar Association. Mr. Eagle is a member of the New York State Bar Association Dispute Resolution Section Mediation and ADR in the Courts Committees, and is a member of the New York City Bar Association Dispute Resolution Committee.
Before entering private practice in 1988, Mr. Eagle was an Assistant District Attorney in Queens County, New York for six and one-half years. As a member of the Homicide Trial Bureau, the Major Offense Prosecution Program, and a Supreme Court Trial Bureau. Mr. Eagle investigated, tried and obtained convictions for murder, other armed and violent felonies, and economic crimes.
Mr. Eagle is admitted to practice law in the United States Court of Appeals for the Second Circuit, the United States District Courts for the Southern and Eastern Districts of New York, before the Supreme Court of the United States, as well as in the State of New York.
Mr. Eagle has taught seminars and workshops in trial advocacy to junior attorneys and judge the moot court and mock trial competitions at St. John’s University School of Law. He is a graduate of the University Of Miami School of Law, where he was a member of the Moot Court Board and served as an instructor, Advanced Moot Court Workshop. In addition to practicing law, Mr. Eagle is a Trustee Emeritus on the Board of Children’s Aid.
Gillian Overland — Attorney, Of Counsel to the Firm
Gillian Overland is Of Counsel to the firm. Representing a broad range of clients, including small to large corporations, family businesses, and individuals, Ms. Overland has extensive experience handling all phases of complex commercial litigation matters, including those involving contract issues, intellectual property, shareholders disputes, business torts, employment disputes, real estate matters, entertainment law. Ms. Overland also negotiates and drafts agreements for clients and also serves as a mediator.
Ms. Overland is admitted to practice law in the United States District Courts for the Southern, Eastern and Northern Districts of New York, as well as in the States of New York, California, New Jersey and Massachusetts. She is a member of the American Bar Association, the New York State Bar Association and the California State Bar Association.
Ms. Overland is a graduate of Boston College Law School.
